In no event shall the Agency be held liable to Client for lost profits of Client, or special consequential damages, even if the Agency has been advised of the possibility of such damages. The Agency’s total liabilities under this Agreement shall not exceed the total amount of fees paid to the Agency by Client under this Agreement. 

The Agency shall not be liable to any claim or demand made against Client by any third party to the extent such claim or demand relates to the site content, functions, privacy, images, copyright, source files, or other proprietary rights pertaining to this project. Client agrees that the Agency is not responsible for GDPR, ADA, CCPA, compliance, or any other personal data and information collected through Client's website. 

Under this Agreement, both parties shall, to the best of their ability, protect the name, reputation, and assets of the other party. Neither the Agency nor Client shall share confidential information about each other to any third party without prior written consent from the other party herein.
