Agency will keep files for three years from creation date. The files and data will be deleted and purged at that time unless Client requests files and documents be transferred and provides the storage device (billable rates may apply).
In no event shall the Agency be held liable to Client for lost profits of Client, or special consequential damages, even if the Agency has been advised of the possibility of such damages. The Agency’s total liabilities under this Agreement shall not exceed the total amount of fees paid to the Agency by Client under this Agreement.
